Terms of use
The terms you agree to by using this website. Plain language, and short, because a page nobody can read is not a protection.
This page is written in plain language and covers the ordinary things a website terms page covers. It is not legal advice and I am not a lawyer. Have your attorney or a nonprofit legal clinic read it before you publish, particularly the liability section, because that is the part that varies by state and the part that matters if it is ever tested.
Who runs this site
This site is operated by Inclusive Ski Touring, a 501(c)(3) nonprofit corporation, EIN 87-1176554, at P.O. Box 278, Hanover, Maine 04237. Where this page says we, us or our, it means Inclusive Ski Touring. Where it says you, it means you, the person using this site.
By using this site you agree to what is on this page. If you do not agree, please do not use the site. That is the whole mechanism, and it is the same on every website you have ever visited.
Using this site
Use the site for its intended purpose: finding out about our programs, signing up for them, reading what we publish, volunteering, and supporting the organization. We ask that you do not do the following, which is a short list and none of it will surprise you.
- Break the law, or use the site to help anyone else break it.
- Attempt to gain access to any part of the site, or any account, that is not yours.
- Interfere with the site working normally for other people, including by scraping it at a rate that affects it, or by attempting to disrupt or overload it.
- Submit anything false, misleading, or impersonating somebody else, in a form or a registration.
- Use anything from this site to harass or endanger any participant, volunteer or member of staff.
Our content, and yours
The words, photographs, guides and design on this site belong to Inclusive Ski Touring or to the people who made them for us, except where a partner logo or a photograph is credited to somebody else. You are welcome to read it, print it, link to it and share it. You may not republish it as your own or sell it.
Our printed guides are free and we want them shared. If you want to use one in a class, a club or another organization, you may, and we would like to hear about it. If you want to adapt one, ask us first.
If you send us something, a photograph, a review, a story or a quote, you keep it. You are giving us permission to publish it on this site and in our materials, and you can withdraw that permission by emailing us and we will take it down. We do not publish a participant photograph or quote without permission in the first place.
Programs are covered elsewhere, not here
This page is about the website. The terms of actually joining a program are in three other places, and those are the ones that matter on a program day: the waiver you sign, our policies and practices, and the cancellation and refund terms on each program page. Where any of those says something different from this page about a program, that one wins.
Two programs book through a partner rather than through us. Ski and Snowboard Mountaineering books through Northeast Mountaineering, and their terms, cancellation policy and waiver apply rather than ours. Any day run with a partner organization may also carry that partner's own terms, and the program page says so where it does.
Links to other sites
We link out a lot, to partner mountains, rental shops, avalanche forecasts, Uphill New England, and organizations doing work near ours. Those sites are not ours and we do not control them. A link is not an endorsement of everything on the other end of it, and their privacy policy and terms apply once you are there rather than ours.
Purchases and donations
Program registrations and anything in the shop are processed by Squarespace and Stripe. Donations are processed the same way. We do not see or store your card number. Refunds on a program follow the cancellation terms on that program's page: in short, if we cancel for any reason you are refunded in full.
A donation is a gift and is tax-deductible to the extent allowed by law. A membership or anything bought in the shop is a purchase rather than a gift, and a program fee buys a place on a program, so none of those is a deductible donation.
What we do not promise
We try hard to keep this site accurate, and prices, dates, uphill policies and rental rates all change. Where a partner mountain or a shop sets the price, we publish what they have told us and we check it before each season, but the mountain or the shop is the authority on their own price. If something here is out of date, tell us and we will fix it.
Nothing on this site is a substitute for professional instruction, for a current avalanche forecast, or for your own judgment in the mountains. Our education pages say the same thing at more length, and they mean it: reading a page does not make terrain safe.
We provide this site as it is. We do not promise it will be available without interruption or free of errors, and to the extent the law allows, we are not liable for loss arising from your use of the site itself. This does not limit anything you are owed under the waiver or under law, and it is not about program participation, which the waiver covers.
Changes to these terms
We may update this page. When we do, the date below changes, and if a change is significant we will say so on the page rather than expecting you to notice. Continuing to use the site after a change means you accept it.
